2. WHAT DATA DO WE USE AND HOW DO WE COLLECT IT?

As part of the initiation and implementation of the business relationship, we process in particular the following categories of data of our business partners or their contact persons, which we have received directly from them or from other companies of the Salzgitter Group or from other third parties (e.g. Schufa) in a permissible manner (e.g. for the fulfilment of contracts or on the basis of consent given). On the other hand, we process data that we have permissibly obtained from publicly accessible sources (e.g. commercial register, press, Internet).

Relevant personal data may include:
  • Personal/contact data (e.g. first name, last name, company, address, telephone number, fax, e-mail)
  • Communication data in connection with correspondence (e-mails, correspondence)
  • Contract and billing data (e.g. bank details, goods ordered, billing data)
  • Legitimation data (e.g. identification documents), authentication data (e.g. specimen signature), Schufa score
  • when accessing or using our IT applications: Log data (e.g. user ID, time stamp, type of access)

3. FOR WHAT PURPOSES AND ON WHAT LEGAL BASIS IS YOUR DATA PROCESSED?

The object of our company is the realization of injection molding machines and systems for the production of technical rubber and silicone molded articles as well as all related technical and commercial services. The data processing is carried out to accomplish these purposes and is in compliance with the provisions of the EU Data Protection Regulation (DSGVO), the Federal Data Protection Act (BDSG) and all other relevant laws (e.g. HGB, AO, etc.).

a. For the execution / fulfillment of a contract or for pre-contractual measures (Art. 6 para. 1b) DSGVO)

Primarily, the processing of personal data serves to fulfill contracts with our customers, suppliers and service providers. This also includes the implementation of pre-contractual measures, at the request of the business partner.

b. In the context of a balancing of interests (Art. 6 para. 1 f DSGVO)

As far as necessary, we process your data beyond the actual fulfillment of the contract to protect our, or third parties, legitimate interests

Examples:

  • Testing and optimization of procedures for needs analysis and direct customer contact
  • Advertising or market and opinion research, insofar as you have not objected to the use of your data
  • Assertion of legal claims and defense in legal disputes
  • Ensuring IT security and IT operations
  • Prevention of criminal acts

  • Access control
c. Based on consent (Art. 6 para. 1 a) DSGVO)

If you have given us consent to process personal data for certain purposes (e.g. newsletter), the lawfulness of this processing is based on your consent. Consent given can be revoked at any time effective for future processing. This also applies to the revocation of declarations of consent given to us prior to the applicability of the GDPR, i.e. prior to May 25, 2018. Please note that the revocation only effects future processing. Processing that took place before the revocation is not affected.

d. Due to legal requirements (Art. 6 para. 1 c) DSGVO) or in the public interest (Art. 6 para. 1 e) DSGVO).

In addition, we are subject to various legal obligations, i.e. statutory requirements, e.g. tax regulations, customs regulations.

4. WHO GETS YOUR DATA?

Within our company, access to your data is granted to those departments that need it in order to fulfill our contractual and legal obligations, or to service providers and vicarious agents employed by us for this purpose.
Data will only be passed on outside the company if required by law or if you have given your consent.
All recipients, for their part, are obligated to comply with data protection laws.
Under these conditions, recipients of personal data may be:

  • Public bodies and institutions (e.g. tax authorities) in the event of a statutory or regulatory obligation
  • Contractors to whom we transfer personal data in order to carry out the business relationship with you (e.g. support/maintenance of IT systems, data destruction, payment transactions, accounting, customs agencies)
  • Those entities for which you have given us your consent to transfer data to, if applicable

A data transfer to countries outside the EU or the EEA (so-called third countries) only takes place if this is required by law for the execution of the contract, if you have given us your consent or in the context of an order processing. If service providers are used in the third country, an appropriate level of data protection is guaranteed.

5. HOW LONG WILL YOUR DATA BE STORED?

We process and store your personal data for as long as it is necessary to fulfill the purposes stated in section 3. It should be noted that our business relationship is generally long-term.
If the data is no longer required for the fulfillment of contractual or legal obligations, it must be deleted on a regular basis, unless its further processing for a limited period is necessary for the following purposes:

  • Compliance with retention periods under commercial and tax law, e.g. under the German Commercial Code or the German Fiscal Code. The periods specified there are 2 to 10 years.
  • Preservation of evidence within the framework of the statute of limitations (e.g. §§ 195ff. BGB).
6. WHAT DATA PROTECTION RIGHTS DO YOU HAVE?

Every data subject has the right to information under Article 15 of the GDPR, the right to rectification under Article 16 of the GDPR, the right to erasure under Article 17 of the GDPR, the right to restriction of processing under Article 18 of the GDPR, the right to object under Article 21 of the GDPR, and the right to data portability under Article 20 of the GDPR. With regard to the right to information and the right to erasure, the restrictions pursuant to Sections 34 and 35 BDSG apply. In addition, there is a right of appeal to the competent data protection supervisory authority (Art. 77 DSGVO in conjunction with § 19 BDSG).

You may revoke your consent to the processing of personal data at any time. This also applies to the revocation of declarations of consent given to us prior to the application of the GDPR, i.e. prior to May 25, 2018. Please note that the revocation is only effective for the future. Processing that took place before the revocation is not affected.

7. IS THERE AN OBLIGATION ON YOUR PART TO PROVIDE DATA?

Within the scope of our business relationship, you must provide personal data required for the establishment and implementation of a business relationship and the fulfillment of the associated contractual obligations, or which we are required to collect by law.


INFORMATION ABOUT YOUR RIGHT TO OBJECT ACCORDING TO ART. 21 DPA-VO

1. right to object on a case-by-case basis

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis of Article 6(1)(e) DSGVO (data processing in the public interest) and Article 6(1)(f) DSGVO (data processing on the basis of a balance of interests).

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the purpose of asserting, exercising or defending legal claims.

2. right to object to the processing of data for advertising purposes

In individual cases, we process your personal data in order to conduct direct advertising. You have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising.

If you object to processing for direct marketing purposes, we will no longer process your personal data for these purposes.

EARMARKED USE

We will collect, process and use the personal data you provide online only for the purposes disclosed to you. Your personal data will not be passed on to third parties without your express consent.

The collection of personal data and its transmission to state institutions and authorities entitled to receive information will only take place within the framework of the relevant laws or if we are obliged to do so by a court decision. Our employees and the service companies commissioned by us are contractually obligated by us to maintain confidentiality and to comply with the provisions of the Federal Data Protection Act.


DATA THAT IS AUTOMATICALLY COLLECTED WHEN YOU VISIT OUR WEBSITE

No data is stored when you use our Internet pages. We do not use any logs or analysis scripts. Only the web server stores the standard logs.

However, these are not normally evaluated. An evaluation only takes place in the case of a justified suspicion or a legal or judicial regulation.


PIWIK – ANALYSIS TOOL

This website uses Piwik, an open source software for statistical analysis of visitor traffic. Piwik uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is stored on the provider’s server in Germany. The IP address is anonymized immediately after processing and before it is stored.
